  Cordette Woodham v. Blue Cross and Blue Shield of Florida, Inc. 829 So.2d 891 (Fla. 2002)

Lisa Monet Fletcher, and attorney Gary L. Printy, prevailed on appeal before the Supreme Court of Florida in a case of first impression regarding the effect of an EEOC "unable to conclude notice" on plaintiff's employment discrimination suit which was filed under the Florida Civil Rights Act.

​

Finding that the EEOC unable to conclude notice did not satisfy the requirements of a no cause finding, the court held plaintiff was entitled to directly file a discrimination suit under Florida law which vests all claimants with a "cause finding" in the event the FCHR fails to make a determination within the statutorily prescribed investigation period.

​

The court also found that the attempted application of the EEOC unable to conclude notice conflicted with the stated remedial purpose of the State's anti-discrimination law. This case has been hailed as the most important case in the history of the Florida Civil Rights Act.
